If and to the extent performance of any of the THG’s obligations pursuant to the T&C and R&R is prevented, hindered or delayed by fire, flood, earthquake, elements of nature or acts of God, acts of war, terrorism, riots, civil disorders, rebellions, revolutions, or other causes or occurrences that could not have been reasonably foreseen and reasonably avoided (each, a “Force Majeure Event”), then the non-performing, hindrance or delay shall be excused for such non-performance, hindrance or delay, as applicable, of those obligations affected by the Force Majeure Event for as long as such Force Majeure event continues. THG shall continue to use all reasonable efforts to recommence performance whenever and to whatever extent possible without delay, including through the use of alternate sources, work around plans or other means. THG whose performance is prevented, hindered or delayed by a Force Majeure event shall immediately notify the USERS the occurrence of the Force Majeure event and describe in reasonable detail the nature of the Force Majeure event. Happening or occurrence of any Force Majeure event does not limit or extinguish the THG’s rights under these T&C and R&R for termination of the Agreement.
